1. About these terms
1.1 These terms are between you and Kaptain Creative Pty Ltd (ABN 23 660 505 411) trading as Australian Trauma Education Centre ("ATEC", "we" or "us"). They apply when you buy a PDF tool from our online shop, and when you download our free Self-Check.
1.2 Our products are for adults aged 18 and over. You agree to these terms when you buy a product.
2. Downloading your product
2.1 You can download your product again from your account at any time for 12 months from the date you buy it. Please download it straight away and keep your own copy.
2.2 After 12 months, you can keep using the copies you have already downloaded. Your licence does not end after 12 months. It only ends if it ends under clause 6 or you get a refund.
2.3 If a file is faulty, incomplete or will not download, tell us at any time. We will send you a working copy, or give you a refund, as set out in our Refund Policy.
3. What you can do
3.1 You can use the product in your own professional work with your own clients, in person or by telehealth.
3.2 You can print it and fill it in. You can give a client a copy of a client handout or worksheet when you use it with them in a session, or as a task you agree they will do between sessions. Clinician notes are for you only.
3.3 The licence is for you as one person. You can show the product in a team meeting or training session that you run, but you cannot give copies to others. Each practitioner who uses the product with their own clients needs their own copy. Organisation and multi-practitioner licences are sold separately on request. Email enquiries@atec.vic.edu.au.
3.4 The free Self-Check is for your own personal use.
4. What you cannot do
4.1 You cannot:
- sell or resell the product, or any part of it;
- share the product, or your account log-in, with colleagues or anyone else, except as allowed in clauses 3.2 and 3.3;
- upload or post the product anywhere other people can get it, such as a website, social media, a shared drive or an online app; or
- remove ATEC's name or copyright notice, or present the product as your own work.
5. Copyright
5.1 ATEC owns the copyright in our products. You are buying a licence to use a product, not the copyright in it.
5.2 Some products describe ideas or frameworks developed by other people. We explain them in our own words and credit the source. Those ideas belong to their creators.
6. If these terms are broken
6.1 If you sell, share, upload or post a product, or present it as your own work, we can end your licence by email. You must then stop using the product and delete your copies. Clients who received copies properly can keep them for their own use.
6.2 This does not take away your rights under the Australian Consumer Law.
7. Your rights and our liability
7.1 Our products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those guarantees, or any other right the law says cannot be excluded. Our Refund Policy explains what we do if a product has a problem.
7.2 Apart from those rights, and to the extent the law allows:
- our total liability to you for anything to do with a product is limited to the price you paid for it; and
- we are not liable for indirect or consequential loss, such as loss of income or loss of business.
7.3 The products are educational tools. You remain responsible for your own professional decisions. Please read our Product Disclaimer.
8. General
8.1 These terms are governed by the law of Victoria, Australia. The courts of Victoria can hear any dispute.
8.2 We may change these terms for future purchases. The terms that applied when you bought a product still apply to that product.
